The Federal Government announced a new measure that releases the balance retained from the Severance Pay Guarantee Fund (FGTS) for workers who opted for the anniversary withdrawal and were dismissed without just cause.<\/p>\n\n\n\n

However, this change, which came into effect on March 6, 2025, corrects a previous limitation and may benefit millions of Brazilians who had their resources blocked after joining the anniversary withdrawal.<\/p>\n\n\n\n

With this new rule, workers dismissed without just cause between January 2020 and February 2025 can finally withdraw the remaining balance from their FGTS accounts.<\/p>\n\n\n\n

What has changed in the FGTS withdrawal?<\/strong><\/h2>\n\n\n\n

Firstly, the anniversary withdrawal, created in 2019, allows workers to withdraw part of their FGTS balance annually in the month of their birthday. <\/p>\n\n\n\n

However, this modality prevented the full withdrawal of the fund in the event of dismissal without just cause, only allowing the withdrawal of the termination fine of 40%.<\/p>\n\n\n\n

However, from the Provisional Measure (MP) 1,290\/2025<\/strong>, this restriction was relaxed. <\/p>\n\n\n\n

Now, workers who signed up for the anniversary withdrawal and were dismissed without just cause can withdraw the remaining balance of the FGTS.<\/p>\n\n\n\n

Therefore, this change represents a major step forward, allowing thousands of people to access funds that were previously blocked.<\/p>\n\n\n\n

Ultimately, this measure should benefit around 12.1 million workers<\/strong>, resulting in the release of approximately R$ 12 billion<\/strong>.<\/p>\n\n\n\n

Who is entitled to withdrawal?<\/strong><\/h2>\n\n\n\n

In principle, to be entitled to withdraw the balance retained from the FGTS, the worker must meet the following criteria:<\/p>\n\n\n\n
